Terms & Conditions

These Terms and Conditions are between Shay Jared West ABN 30 376 056 322 trading as Peak Pilates & PT and the Member.

Peak Pilates & PT is an independently owned and operated studio.

1. Membership Services

Membership Services may include Reformer Pilates classes, Strength classes, Personal Training sessions, Private Pilates sessions, wellness and recovery services, and any additional services offered from time to time.

2. Membership and Acceptance

You accept these Terms by completing your membership application, accepting via Clubworx, or confirming acceptance by email.

A seven (7) day cooling-off period applies from the Start Date. Notice during the cooling-off period must be sent to [email protected].

3. Membership Fees and Payment

Membership fees may be paid upfront or by weekly direct debit. Membership fees continue until cancelled in accordance with these Terms.

A failed direct debit may incur an Ezidebit Failed Payment Fee. We reserve the right to suspend Membership Services where payments remain outstanding.

4. Bookings

Bookings are required for all classes and private sessions. Bookings can be made via Clubworx or directly with the studio. Bookings are only confirmed once confirmation has been issued.

5. Cancellation Policy

Private Sessions

Same-day cancellations for Personal Training or Private Pilates sessions will incur the full session fee and are not eligible for a make-up session.

Group Strength and Reformer Pilates Classes

Same-day cancellations are eligible for a make-up class, subject to availability and booking policies.

6. Membership Changes, Pauses and Credits

Requests to pause Memberships, skip weeks, amend schedules or alter payments must be received before the weekly payment has been processed, usually by the Sunday commencing the new week.

Where payment has already been processed, payments remain as account credit, credits may be used towards future services, and credits are non-refundable except where required by law.

7. Membership Suspension and Cancellation

Approved Membership suspensions must be requested in writing, received before the Sunday commencing the new payment week, have a minimum suspension period of one (1) week, have a maximum suspension period of six (6) weeks, and may only be utilised once in any six (6) month period.

Members may permanently cancel their Membership by providing written notice before the Sunday commencing the new payment week.

Permanent cancellation of a Membership will not incur any cancellation fee or payout fee. Upon cancellation, all future direct debits will cease from the next applicable payment cycle and the Membership will end.

A cancelled Membership is considered final and remains inactive until the member chooses to return and enters into a new Membership agreement.

8. Member Responsibilities

You agree to follow all instructions, use equipment safely, treat staff and other members respectfully, advise us of medical conditions or injuries, wear appropriate clothing, and refrain from participating while under the influence of alcohol or prohibited drugs.

9. Limitation of Liability

Participation in fitness activities involves inherent risks. To the maximum extent permitted by law, Peak Pilates & PT excludes all liability arising from participation in Membership Services except where liability cannot be excluded under Australian Consumer Law.

10. Privacy

Personal information is collected for the purpose of administering Membership Services and is handled in accordance with our Privacy Policy.
