Waiver & Release of Liability

This Waiver and Release of Liability is entered into between Shay Jared West ABN 30 376 056 322 trading as Peak Pilates & PT, its successors and assignees, and you, the Member.

1. Acceptance

By accepting this Waiver, you confirm that you have had sufficient opportunity to read and understand this Waiver and seek independent advice if required.

If you are under 18 years of age, this Waiver must be accepted by your parent or legal guardian.

2. Risk Warning

You acknowledge that participation in pilates, personal training, strength training, exercise programs and related activities involves inherent risks, including physical injury, illness, aggravation of existing injuries, property damage or loss, and in rare circumstances, serious injury or death.

You voluntarily assume all risks associated with participation in the Activities.

3. Warning under the Civil Liability Act 2002 (NSW)

The Activities are recreational activities and recreational services for the purposes of the Civil Liability Act 2002 (NSW) and Australian Consumer Law.

To the maximum extent permitted by law, you release and discharge Peak Pilates & PT and its employees, contractors, trainers and agents from liability arising from your participation in the Activities, except where liability cannot be excluded by law.

4. Participant Responsibilities

You agree to disclose all medical conditions or injuries that may affect participation, follow all instructions and safety directions, refrain from participating under the influence of alcohol or prohibited drugs, immediately report injuries or incidents, and behave responsibly and safely.

5. Release and Indemnity

To the maximum extent permitted by law, you release and forever discharge Peak Pilates & PT from all claims arising out of participation in the Activities and indemnify Peak Pilates & PT against all claims, losses, costs and expenses arising from your participation in the Activities or breach of this Waiver.

6. Warranties

You warrant that you are physically capable of participating, all information provided is accurate and complete, you have obtained medical advice where necessary, and you are at least 18 years old or have parental consent.

7. General

This Waiver is governed by the laws of New South Wales. If any provision is invalid, the remaining provisions continue in full force.
